Product Notice

Unless specifically designated otherwise by the manufacturer, all products sold by Desmo Times are assumed to be designed and manufactured strictly for racing applications or incorporation on street machines which are used for racing. They are not intended for street use, and some products may, in some localities, be illegal for use on the street. Motorcycle racing is a dangerous activity. While every effort has been made to ensure that products sold by Desmo Times, are designed and manufactured to the highest possible quality standards, Desmo Times, cannot assume responsibility for property damage or personal injury incurred by or concurrent with the use of the products, even if such damage or injury is the direct result of the failure of the product sold by Desmo Times. Desmo Times assumes individuals performing the installation of its products to be certified professional motorcycle maintenance technicians or qualified race mechanics, who can make the judgements and adjustments which may be necessary in the installation process, and which cannot be anticipated by the product manufacturer or Desmo Times in advance, in order that the installation is a safe and proper one. Desmo Times assumes no responsibility for damage or personal injury which may be caused by the manner in which products sold are installed. If you use products sold by Desmo Times, you use them at your own risk. We want you to be healthy, to ride safely, and enjoy a long lifetime of motorcycling. Please do not use any product if you are uncertain of your ability to properly install it.

Purchasing notes
Your credit card is automatically charged via the online process. Please understand that the merchant agreement governing this type of transaction allows up to 7 days for product to ship once the credit card is charged. The charge will appear on your statement as Desmo Times. Payment via PayPal is accepted, but products will only ship once they clear Paypal into our account. If you have the funds already in your paypal account, we receive the funds immediately. If you don't have a direct account transfer setup, or are a new user of Paypal, the transfer of funds into our account will take 3 business days. That means that although you make a paypal purchase, the money may leave your account and not show up in our account for 3 business days. We will inform you of the impending shipment, but will not ship until the funds reach our account. If you don't wish this delay, either have the funds already in your paypal account, or purchase with a credit card. Sales Tax is added to all products delivered to Florida.

About your information and your credit card
Desmo Times does not and will not sell or give your information for others to use, profit from, nor conduct market research. The billing address provided will be confirmed with your credit card's issuing bank to prevent fraud.

Desmo Times does not store credit card numbers. The shopping cart collects these numbers but destroys them after 90 days.

Chargebacks and Credit card fraud
Charges to your card will show up as "Desmo Times". Should you issue a chargeback on your credit card denying the charge, this is considered credit card fraud. Credit card abuse or fraud is taken very seriously and any fraud attempts will be reported to credit card companies and relevant authorities: the FBI, Pensacola PD, and the law enforcement agency for the address provided with any order. Your IP address and a date/time stamp are logged with your order and will assist any ensuing investigations. Shuold I have to recharge your credit card, a $25 fee will be applied to refund me for the chargeback fees I have to pay.

Inventory & delivery time notes
Desmo Times inventories most items for immediate shipment. If an item is out of stock and you order that product, your CC is still charged. For most items, restock takes place in a few days. For items that take longer, I indicate such on the website.

Back orders
Sometimes a product you desire is not readily available. In these circumstances, you will be contacted with shipping options. If you desire, the order can be split or held for shipment at one time.

Shipping in the USA
Desmo Times uses USPS with delivery confirmation for all shipments. USPS provides delivery confirmation, NOT tracking. Once you receive a delivery confirmation number the USPS online system will show when the label was created, when the post office received the package and when it was delivered. Anticipated delivery dates are not provided. USPS is the most cost effective means to ship a product, but if you want something sent UPS or Fedex we will do so. Be aware that UPS and Fedex charges are approximately double that of USPS.

Shipments must be sent to a verified USPS address. Desmo Times will not assume liability for shipments to Non-Verified USPS addresses. I ship via USPS priority mail. For items over $500 in value, signature confirmation is used to protect both the consumer and Desmo Times. I do NOT offer insurance unless you specifically request unsurance prior to ordering. Delivery confirmation from USPS is the shipper's and the shippee's notification that the package has arrived. Furthermore, USPS confirmation of delivery is a bonafide affirmation of delivery. If you specified shipment to an address other than your billing address, I suggest you let somebody know the package is arriving. Again, if the tracking # shows up as delivered, it was, in fact, delivered. USPS has NEVER missed delivering one of my packages. Should you wish signature confirmation, you must specify that ahead of time.

International shipping
Please do not ask for a "gift" shipment. This is illegal and our agents sign a US government document at the time of shipping asserting the contents and purpose of the shipment. The US Postal Inspectors have enough work without Desmo Times adding to it. If you are determined to avoid paying import duties, have a friend in the US buy the parts and have them send the items to you. Since they know you, they would be more likely to give you costly motorcycle parts then a complete stranger who coincidentally is a motorcycle parts vendor.

For international shipping, Global Priority Mail Service for books is used, and Global Priority or Global Express Mail for products exceeding $250. No tracking is possible with packages shipped via Global Priority Mail. If your order is less than $350 and you still want tracking, you must specify to me prior to shipment that you want Global Express Mail. This will double the shipping costs to you, but the package will be insured.

Visit the international postage rate calculator at USPS.com. Here are the steps to get an idea of the pricing: Click "A Package", select your country, guess the weight of the parcel, and click OK. The next screen shows the postage rates. Global Express Mail includes $100 of insurance for free. For example, a 9 pound box will ship to the UK in 2-3 days for $55.

My shopping cart isn't smart enough to judge the charges for each specific country, so it selects set charges based on weight rather than country. In most cases, it overestimates charges. Final shipping charges will be made when I ship the item(s). The shipping charge that shows up on your emailed receipt/Shopping Cart notification is NOT the actual shipping cost. I charge a 2.50 handling fee for any international shipment above the actual shipping costs

NORMAL shipping time depends on country, but in general the package will arrive within 2-3 weeks. However, depending on the country, delivery time can be upwards of 4-6 weeks. I have no control over customs officers abroad. Therefore, please don't email me with questions about where your package is until a month has passed.

There is no insurance made on international shipments. If you want the package insured, let me know and I will apply appropriate insurance. Should the postal service in your country attempt to deliver the box and nobody is there to receive it, you are at risk. Packages are shipped "return to sender" if you are not there to receive the package, but most post offices are hesitant to ship the package around the world again for free. Hence, once a package appears in USPS online as either delivered or a delivery attempt having been made, the liability of Desmo Times ceases. I'll get the package from me to your door. If nobody is there to receive it, the blame passes to the customer.Again, if you want insurance to guarantee things, contact me prior to placing your order. USPS is the most cost-effective means of international shipments. If you wish UPS or Fedex shipments, I can oblige, but shipping costs will be triple those of USPS.


Returns and order cancellations

Returns happen, it is a fact of life. This section is to ensure that as a customer, you will receive the best possible service from Desmo Times. The paragraphs below are to make sure that customers' expectations match that of Desmo Times. When you buy a product and wish to return it, this product MUST be returned in such a way so that it can then be resold to another customer. When you opened your box and saw your new parts therein, there were no fingerprints and the pakaging is intact. Your new product is YOURS, not someone else's rejects. This is how the NEXT customer needs to feel about the product YOU return.

Perhaps there is a quality issue with the item you received. Before contacting your credit card company, read and understand the below information and understand that these terms are binding. Sometimes, the quality of the product you received is "acceptable" to industry standards and it is your expectation which is too high. This is rare with Desmo Times products but does not grant customers the right to render the product unsellable before returning it. More about defective / quality issues in it's own section below.

Defective Parts

Desmo Times vendors are held to a high standard. High standards for quality control and also for customer service, which means the vendors and manufacturers of the products for sale here must stand behind their product or it will not be listed. Desmo Times will act as your advocate with the product manufacturer and/or importer. The rare times a product has not lived up to normal expectations, resolution for the customer will be achieved. Defective products in unused condition may be returned and there will be no restocking fees. It is important that you as a customer communicate with Desmo Times any failed expectations so that the manufacturer can be brought to task over the bad condition. Product manufacturers and Desmo Times rely upon satisfied customers to uphold our good reputations.

Incorrect Part Shipments

Although rare, incorrect parts can be sent by mistake. If you are shipped an incorrect part, Desmo Times will send you the correct part without additional shipping charge. However, the incorrect part must be returned or an additional charge will be placed for the incorrect part should you decide to keep it. Desmo Times does not reimburse shipping costs for returned items. The returned part must be received before Desmo Times will ship you the correct part. If you need the correct part immediately, Desmo Times will send it, but a charge will be levied for the incorrect part until it is returned.

Not so fine print

The conditions set forth in this section came to be required because not everyone understands how business and credit card accounts work. Please understand that Desmo Times main goal is for customers to buy good product and be happy with their experience.

No part, once used, may be returned. Returns are accepted for unused products in original, resellable condition only - no bolt impressions from installation or evidence of actual use. All original retail packaging must be intact. The item must be returned in the exact condition as received or there will be no refund. Customer is responsible for return shipping of denied returns. Returns must be preapproved. While deposits are not required for special orders, a restocking fee of up to 15% may be charged for cancelled orders once they have shipped from the manufacturer or vendor. If you receive product and render it unsellable or return it in unsellable condition, there cannot be a refund.
Shipping charges are not refundable.


Credit Card companies
Should you as a customer initiate "chargeback" proceedings, you must return the merchandise in new and resellable condition. Failure to do so means that you are attempting to either retain Desmo Times property without paying for it OR an attempt is being made to use Desmo Times merchandise without payment and suit will be filed in small claims court and/or a police investigation for theft will be initiated. Once your chargeback request has been overturned, there is $5 per page document fee for any paperwork generated by Desmo Times in the defense of your action. This is chargeable to your credit card, consented to upon placing any order with Desmo Times.

Time frame of the credit
Returns and credits are infrequent enough that there is not yet a set process for handling the review of returned product and then for processing the credits. Once a returned item has been delivered, please allow 2 weeks for Desmo Times to act. If a month passes, now is the time to start bugging the friendly but sometimes overworked company owner to make sure the credit is posted to your card.
